Cross-border enforcement
Enforcing a Portugal judgment in Luxembourg
Brussels Ia applies. A Portuguese judgment in a civil or commercial matter moves to Luxembourg without an exequatur, recognised automatically as an EU judgment moving between member states. The mechanism works, but only within its scope. A decision outside civil and commercial matters, or one that never became enforceable in Portugal, does not travel this route.
Applicable regime
The Portugal-to-Luxembourg route runs through the Brussels Ia Regulation (1215/2012). A judgment given by a Portuguese court in a civil or commercial matter is recognised in Luxembourg automatically, with no intermediate exequatur procedure required. This is the mechanism itself.
Luxembourg still applies a general exequatur procedure to judgments arriving without a treaty basis. Brussels Ia displaces that procedure between EU member states, so the general rule does not reach a Portuguese judgment. Both states are member states, and neither has carved itself out of the Regulation for this purpose.
General treatment of incoming decisions in Luxembourg is set out on the Luxembourg jurisdiction page. The broader outbound picture for Portuguese judgments, beyond this one destination, is covered separately under judgments originating in Portugal.
What the destination court will check
Recognition itself needs no filing. The checks below matter once enforcement steps begin, for example when a bailiff is asked to act on the judgment. Handling this sequence is the core of our cross-border recognition and enforcement work.
- The judgment was given by a court of an EU member state, here Portugal.
- The matter falls within the civil and commercial scope the Regulation covers.
- The judgment is enforceable in Portugal at the time enforcement is sought in Luxembourg.
- The party seeking enforcement produces a copy of the judgment and the standard certificate issued by the Portuguese court.
These conditions are cumulative. None of them opens a review of the merits; Luxembourg does not re-decide the underlying dispute. Which office within the Luxembourg system handles the certificate and the enforcement request depends on the applicable procedural rules.
What will not go through
Arbitral awards do not travel this route. They move under the New York Convention, a separate and wider mechanism than any judgment-based regime (see how non-enforcement is classified more generally on the O8 non-enforcement page).
A decision from a court outside the EU member states does not qualify for this automatic route, regardless of its content. Nor does a decision that never became enforceable in Portugal itself. Enforceability at the source is itself a condition of recognition in Luxembourg.
Whether a freezing or other protective measure is available while these questions are worked out is established from the case file, not from a general rule stated on this page.
Documents
Luxembourg is a party to the Hague Apostille Convention, in force there since 3 June 1979. Supporting documents produced outside the judgment itself, such as powers of attorney or evidence of standing, may need an apostille if they originate outside Luxembourg and are not otherwise exempted.
Whether a certified translation is required, and into which language, depends on the receiving office and the document set involved. The registry does not fix a general rule for this, so it needs confirming against the specific filing before anything is submitted.
Timing
Luxembourg applies a general enforcement limitation period of thirty years. For how limitation periods are tracked across different enforcement destinations, see the comparison of limitation periods by jurisdiction. The registry does not fix the exact moment this period starts running for a judgment recognised under Brussels Ia rather than issued domestically; that detail needs checking against the specific judgment and filing date.
Luxembourg does not operate a system of proportional court fees tied to the value of the claim. The costs that matter in practice are the bailiff's fee for the enforcement act and the lawyer's fee for the file. A foreign claimant can also be required to post security for costs if the debtor asks for it, a separate exposure that sits alongside the enforcement timetable rather than inside it.
If the primary route is closed
If the decision falls outside civil and commercial matters, or the connection to an EU member state is missing, this direct route does not apply. Hague 2019 can serve as a conduit elsewhere. The EU acceded in August 2022, in force from September 2023, covering both Luxembourg and Portugal. It reaches only proceedings instituted after the Convention was already in force between the states involved, so it supplements Brussels Ia rather than replacing it in this pairing.
Arbitration remains the most portable option for anything not yet decided. An award enforced under the New York Convention reaches more jurisdictions than any judgment-based route. That choice gets made when drafting the contract, not after a judgment already exists.
The reverse direction, a Luxembourg judgment enforced in Portugal, runs on the same Regulation but is a separate filing. See enforcing a Luxembourg judgment in Portugal. Where the origin state is not Portugal, the applicable regime changes; the index of routes into Luxembourg sets out what applies by origin jurisdiction.
What to do before filing
Before relying on automatic recognition, confirm the debtor still has assets in Luxembourg reachable by a bailiff. Recognition without exequatur removes one procedural layer. It does not locate money that has already moved. A debtor anticipating a Luxembourg enforcement step has reason to move assets first, a pattern discussed in a comparable setting in our note on enforcing against a debtor who has left the jurisdiction.
Whether a freezing or other protective measure is available at this stage in Luxembourg is established from the case file, not from a general statement here.
The other side of the ledger also matters: a foreign claimant can be asked to post security for costs, and resisting that request is not automatic. This firm does not work on a success-fee-only basis, and its legal entity can be checked against the public register linked in the footer.
