Jurisdiction
Ireland: investor claims and enforcement
Ireland is a common law jurisdiction inside the EU, and a domicile for many private investment fund structures. When a counterparty refuses to pay, redeem or deliver, the assets often sit in Ireland even though the deal was negotiated elsewhere. We track Ireland among the other jurisdictions we cover.
Recognition in and out
A judgment only matters once it can move into the place where the assets sit. Recognising a foreign judgment in Ireland, or moving an Irish judgment abroad, depends on which convention or regulation connects the two states, and on the type of decision issued. This needs checking for the specific pair of jurisdictions involved. The competent authority for the recognition step is determined by the applicable procedural rule. Any limitation period depends on the governing law and needs checking against the specific claim. Court fees are confirmed at the point of filing. What follows recognition, turning a judgment into orders against Irish assets, is covered on our enforcement page.
Asset classes that concentrate here
Ireland is a common domicile for regulated investment funds and for special purpose vehicles holding private equity and debt positions. An investor in a feeder fund or a fund-linked note may find the paying entity sits in Ireland, even though the manager and the marketing were elsewhere. The same pattern appears in other fund domiciles, including the one covered on our British Virgin Islands page. Platform terms often narrow what can be claimed before a dispute even starts. That limitation is examined in our note on platform terms.
What to secure early
Before a counterparty reacts, secure the subscription agreement and any redemption notice. Keep correspondence on the amount owed and a current registry extract showing who holds the shares now. Evidence gaps are where claims commonly lose ground later, a pattern set out in our note on evidence failures. Non-payment rarely arrives as one clean event; it usually follows a sequence described on our refusals page. Whether an interim measure to freeze assets is available before judgment depends on the facts of the case. Weigh the likely cost against the likely recovery before committing further, a question addressed in our note on claim economics.
Working with local counsel
We work with local counsel in Ireland case by case. We do not claim rights of audience we do not hold. Any lawyer we instruct is named for that specific matter, and their standing can be checked against the relevant professional register. We do not work on a result-only fee, and our own registration can be verified the same way, as set out on our page on verifying a law firm.
