Art in Germany: register, custody and paperwork
Art does not sit in a public title register in Germany. Custody, meaning who physically holds the piece and under what agreement, secures the position instead. When a seller or platform refuses to perform, the first question is who controls the piece now and what document proves it. Ownership on paper is a separate question from where the piece actually sits.
Register and custody layer
There is no German land-registry equivalent for paintings, sculptures or collectibles. Title follows possession and contract, not entry in a database. The custody layer, meaning the freeport, gallery, art handler, storage facility or transport company physically holding the piece, is what determines who can be made to act. A claim against a seller who no longer holds the work runs into a different structure than a claim against the party in physical custody. The document rarely handed over
Buyers typically receive an invoice, a certificate of authenticity or a condition report. They rarely receive the custody statement, a dated record of who held the piece, where, and under what terms, from purchase until payment or delivery stopped. Without that record, locating the asset at the point of refusal relies on inference rather than proof. Where the underlying documents were issued outside Germany and need to be used here, legalisation matters. Germany accepts apostille under the Hague Convention, subject to a reservation and notification on file. Whether a given document needs one is a separate question from whether it exists.
What belongs in a pre-deal report
A pre-deal report on an art holding in Germany checks the mechanics behind the sale rather than the artwork's merits. It should establish:
- Who currently holds the piece, and under what custody agreement.
- Whether the counterparty is the party actually in possession or an intermediary.
- Whether title or provenance documents were issued abroad and what legalisation they carry.
- What a claim into the German jurisdiction would require at this stage.
