Asset class

Collectible assets in United Kingdom

Metals, wine, watches and cars held through UK structures do not sit on a central register of title. Ownership rests on possession, an invoice chain and storage documentation, not on an entry anyone can query. When a scheme stops paying out, the first question is not the contract wording but what actually records who owns the physical item.

Register and custody layer

For collectible tangibles there is no register comparable to CREST for securities or HM Land Registry for real property. What exists instead is a custody layer: the bonded warehouse ledger for wine, the insurer's schedule for watches, the marque specialist's inventory record for cars, the refiner's vault statement for metals. These are private records, held by the custodian or the platform, not filed with any public authority. Where a document needs to move across a border, for example to support a claim or a witness statement abroad, it sometimes requires legalisation first. The UK is party to the Hague Apostille Convention, in force since 24 January 1965, with a reservation on scope and thirteen territorial extensions recorded against it[N403]. Whether that route applies to a given document is checked on the document itself, not assumed from the asset class.

The document rarely handed over

Investors in metals, wine, watches or car schemes are usually given a subscription agreement, a certificate of allocation, sometimes a photograph of the item. What they rarely receive is the custody statement showing the asset was segregated, insured and traceable to a specific serial number, vintage or lot from the point of purchase. Without that document, the certificate is a promise rather than a record of title. Whether that gap can be closed depends on how ownership of these assets is actually recorded, which varies by custodian and by asset.

What belongs in a pre-deal report

A pre-deal report for this asset class should confirm, against the documents supplied rather than the marketing material:

A paid initial review sets these points against the file, and states plainly what is established and what is not, before any step is taken toward recovery. That is where a collectible asset file is examined against what the custody layer can actually show.
