Switzerland: investor claims and enforcement

Switzerland sits outside the EU judgment framework but runs its own recognition treaty with EU and EFTA states. A Swiss judgment, or a foreign one aimed at Swiss assets, is enforced under that treaty's terms rather than by default reciprocity. Recognition in and out

Switzerland is not a party to the Hague 2019 Judgments Convention. Recognition with EU and EFTA states instead runs through the Lugano Convention, which applies in place of Brussels Ia. Where a debtor's assets sit in Switzerland but the debtor is domiciled abroad, an arrest of those assets is available, and the application for exequatur can be filed alongside the arrest request rather than after it. Asset classes that concentrate here

Private wealth concentrates in Switzerland through bank accounts, custody arrangements, and holding companies set up to protect assets rather than run an operating business. Fund interests, loan notes, and shareholdings routed through a Swiss holding vehicle surface in disputes when the vehicle itself becomes the target, separate from the underlying investment it holds.

The same features that draw capital, established custodial infrastructure and treaty access among them, make a Swiss-domiciled counterparty a plausible target once a claim needs an asset to attach to. What to secure early

Document the underlying obligation before any contact with the counterparty changes its position. A written demand fixes the date from which later conduct can be measured; the practical effect of sending one is covered separately at what a written demand actually changes.

Once a Swiss court judgment exists, the right it confirms remains enforceable for ten years, and a fresh ten-year period starts running from the date that judgment became final. The equivalent period for an arbitral award sits on separate footing and is not stated on this page, since the underlying rule carries only a low-confidence internal status. Where the claim proceeds with a plaintiff who has no Swiss domicile, expect a request for security for costs from the other side; budgeting for that request early avoids delay once proceedings start.

Swiss civil procedure runs in French, German, or Italian depending on the canton, and appearing before a Swiss court requires counsel admitted there.
