Portugal: investor claims and enforcement

Portugal enforces confirmed foreign judgments and recognises EU judgments directly, but investors holding a stake in a Portuguese fund, holding vehicle, or property SPV still face a distinct confirmation step for anything originating outside the EU. Recognition in and out

Into Portugal, judgments from other EU member states circulate without a separate exequatur step. Judgments from outside the EU need revisao e confirmacao before the Tribunal da Relacao, and the underlying decision must be transitado em julgado, meaning final under the law of the country that issued it. The court fee is calculated in UC units of 102 EUR each, roughly 306 EUR if the debtor does not oppose and 612 EUR, paid in two instalments, if they do. Out of Portugal, a Portuguese judgment travels under the same EU regime into other member states. Once a foreign judgment is confirmed, enforcement against a debtor's assets in Portugal stays open for twenty years. Portugal joined Hague 2019 through the EU's accession, in force since 1 September 2023. Documents from Apostille Convention states qualify under that Convention, though Portugal has entered a reservation under position 13 of the treaty.

Asset classes that concentrate here

Property vehicles, rental-income structures, and holding companhias draw private capital because ownership usually routes through a local company rather than a direct deed. Golden-visa linked funds and resale-focused SPVs keep the underlying asset and its income inside Portugal, which is why a non-payment dispute on one of these vehicles almost always needs an enforcement step inside the country, not abroad. The pattern of concentration is different in Germany, where the asset classes and the applicable route diverge from what applies here.

What to secure early

Before a counterparty in Portugal has a chance to react, gather the constitutive documents, the cap table or land registry entry, and every written instruction that describes the promised return.
